Version 2026-10-draft-2
1. Scope and definitions
These terms add to the Terms of Service and apply to eSIM data plans and top-ups you buy through Hainaner (“plans”). On eSIM matters, if the two differ, these terms control.
“eSIM” is an electronic SIM profile installed on your phone or other device; the “supplier” is the third party that supplies and activates the eSIM for us (for example Airalo); the “network” is the mobile network named on the plan page that carries the data.
A plan is data only. It includes no phone number and no voice calls or SMS unless the plan page says so clearly.
2. Who we sell to
Plans are for inbound visitors to Hainan and elsewhere in mainland China, and for travellers who hold an eSIM-capable device and need data while there.
A plan is not a number or plan from a mainland China basic telecom operator and does not replace the real-name mobile number a resident of the mainland would register. Residents who use a mainland operator's number should deal with that operator directly. We do not sell or arrange any operator's phone number.
By buying you confirm that you are buying for use while travelling in mainland China and that you will comply with the laws of the People's Republic of China.
3. Network, speed and availability
The plan page names the carrying network. The network is provided by the supplier and the mobile network operators it works with, currently China Mobile's network, which the supplier may change; the plan page and the order page control. We have no partnership with China Mobile; the network is provided by the supplier.
Data reaches the internet through a roaming route. Whether Google, WhatsApp, Instagram and similar services work, and how fast, depends on the network, the route and the third-party service at the time, and changes. We do not and cannot promise that any particular site or app will be available at any time or without extra tools.
Speed depends on your location, signal, device and congestion and is not guaranteed. Fair-use rules shown on the plan page (such as slower speeds after a quantity of data) are the supplier's.
4. Device compatibility and your confirmation
Before buying, confirm that your device supports eSIM and is not locked to a carrier. Dialling *#06# and seeing an EID usually means the device supports eSIM. Many phones sold in mainland China (for example dual physical SIM versions) do not support eSIM.
Before you pay, the page asks you to tick that your device is compatible. If an eSIM cannot be installed or used because the device is incompatible, locked or used incorrectly, that is within your responsibility and section 9 applies.
5. Orders, price and email
Prices are shown and charged in US dollars. The yuan figure on the page is only a guide at a reference rate; the amount debited, the rate and any fees are decided by your card issuer. Online payment is processed by Stripe.
You enter and re-enter your email address; the QR code link and receipt are sent there. Check it carefully: if a mistyped address sends the link to someone else, the consequences are yours. You can reopen the order from the same browser you paid with or from the link in the email.
6. Delivery and keeping your QR code
After payment succeeds the order page shows the QR code and manual installation details; the email carries only the order link, never the QR code. The QR code is a one-time installation credential: take a screenshot or save it at once.
A QR code can usually be installed only once, and an eSIM that has been deleted usually cannot be reinstalled. Anyone with the order link or the QR code can view or install it, so do not forward it or post it publicly. The order link currently has no expiry and cannot be revoked; if you suspect it has leaked, contact us at once.
After payment we submit the activation to the supplier as soon as we can. If the page stays on “preparing” for long, contact us; we will check with the supplier, and a paid order we cannot deliver is refunded in full.
7. Validity, activation and top-ups
Validity and how it starts are as shown on the plan page (usually from first connection to the network, or as the supplier sets). When validity ends or the data is used up, what remains lapses and is not paid out.
A top-up can only be added to the same eSIM you already bought and is subject to the supplier's limits on that eSIM.
8. Lawful use
You must not:
- use a plan for unlawful activity or to spread content the law prohibits;
- resell plans or QR codes in bulk, or interfere with the supplier or the network;
- breach the supplier's fair-use rules or use a plan in a way clearly out of proportion to personal travel.
9. Refunds
As in the Cancellation and Refund Policy:
- if after payment the supplier fails to activate or we fail to deliver a usable eSIM: full refund;
- if an eSIM was delivered but, once verified, the supplier's network or activation was at fault so that it cannot be used: replacement or refund, as we agree with you;
- once a usable eSIM has been delivered, a request to refund for personal reasons (you no longer want it, your trip changed, the device is incompatible, it has been activated or used): no refund. An eSIM is a digital good delivered online that cannot be taken back, and under the Consumer Rights Protection Law's rule on digital goods the seven-day no-reason return does not apply; this was shown to you before you paid;
- where the law provides otherwise, the law applies.
10. Liability
We accept the liability the law imposes for personal injury and property loss caused by our intent or gross negligence and do not limit it. Beyond that, to the extent the law allows, we are not liable for loss caused by mobile network outages, lack of coverage, unavailability of third-party services or other causes outside our reasonable control, or for indirect loss or lost profit, and our liability for an order is limited to the amount you actually paid for it, unless the law provides otherwise.
11. Personal information
We process your email and order details to complete the order. When we ask the supplier to activate an eSIM we send the plan code, quantity and our order reference, not your email. The eSIM profile the supplier creates is stored encrypted in our system so we can show you the QR code. See the Privacy Policy.
12. Contact and disputes
For plan questions contact hello@hainaner.com; complaint hotline [to be completed: complaint hotline]. Disputes are resolved as set out in section 10 of the Terms of Service.
